The tax landscape in the business sector frequently changes in North America, and many companies are completely oblivious to the announced changes and the impact of these changes. Changes may be prompted in part because governments at all levels (including municipalities and counties and federal governments) are struggling with massive budget deficits and debts. As an example of important tax regulations, in the United States and in Canada, businesses need to be aware of the tax code as it pertains to the tax treatment and deductibility of a cellphone, from corporate taxes in the U.S. and from the employee taxable benefit perspective in Canada.

The IRS in the U.S. is taking a slightly different approach from Canada in that it is focusing on companies rather than individuals and emphasizes that the company must be tax compliant. This could result in a more efficient tax collection process. In general, you can deduct only the business portion of any business expense, including business use of your home or car and anything else you may use for business. Therefore, it's helpful to require employees to maintain a "mileage book" for the car and cellphone, as well as details about your wireless subscription plan, so that you can present it to the IRS. To remain compliant with the IRS's cellphone policy, you should document business and personal usage for every call, text message and packet of data. A company can't deduct 100% of the cellphone from corporate taxes. Only the documented and substantiated business portion of the cellphone may be deducted.

For many companies in Canada and the U.S., the first inkling of a problem is when a company is audited or employees are suddenly faced with a surprisingly large tax demand. Ultimately an employee is responsible for the accuracy of their tax filing, but all typically trust their employers to ensure that their tax forms are properly filled out. It turns out many Canadian and U.S. corporations I've worked with are unaware of the tax code around cellphones. This could open the door to lawsuits like the BYOD one in California. Employees may demand that their employers reimburse them for their phone use.

Like the IRS's policy, the Canada Revenue Association's (CRA) policy for employers doesn't say not to worry about cellphones, either: The onus is on employers to provide documentation about the percentage of the device usage attributed to work, as well as the fair market value (FMV) of the device. The CRA states explicitly that "if part of the use of the cell phone or Internet service is personal, you have to include the value of the personal use in your employee's income as a taxable benefit. The value of the benefit is based on the FMV of the service, minus any amounts your employee reimburses you." The CRA is being unambiguously clear: At a minimum, the CRA expects employers to calculate the personal usage of cellphones and the associated FMV.

The CRA also says, “You, as the employer, are responsible for determining the percentage of employment use and the FMV. You have to be prepared to justify your position if we ask you to do so.”

The Canadian government is also focusing on the HST (the Canadian national sales tax) portion of operating expenses. HST is relevant for employers and their HST input tax credit (ITC). Only the percentage use of the HST that is associated with commercial (business) purposes may be claimed.

As the CEO of a company that offers a mobile cost management solution, I'm familiar with what it takes to navigate these requirements. Here are some tips for keeping your records up to date:

• Ask your employees to keep a log of business usage (calls, text messages and data). Think of smartphone usage like car mileage for a car that is used for business purposes; you need to keep a log.

• Start to keep historical records. In the U.S., authorities can ask to go back several years in an audit situation.

• Because a significant portion of smartphone expenses can come from data, find a way to indicate what usage is business versus personal. This cannot typically be done manually from your wireless bill for data, as many wireless service providers do not provide this level of detail, but you can use your wireless bill to track voice calls and text messages. To track your data usage, either use a data tracker app or use the app that comes with iOS or Android to view your data consumption per app. Just remember to note the consumption of the app before you use it for work purposes and then note your consumption after use. The difference will give you your business use.

• Find a mobile cost management solution for individual devices or corporate device fleets that can automatically work out the business portion of all your calls, text messages, wireless data and Wi-Fi usage. Today, many businesses use Telephony Expense Management (TEM) solutions such as vCom's and Valicom's and mobile cost management solutions such as my company's.

I know many businesses that have been speaking to wireless service providers for a solution to this problem, but no solution has been forthcoming.

Walters created the original piece by layering paint and collage, a process she says reflects the layers of life.

“I wanted to portray the warmth and charm of winter in the Old Mill District,” says Walters, a lifelong Oregonian who moved to Bend from Seaside 40 years ago. “Summer’s easy. Winter’s tougher. It’s not as vibrant outside and I was intrigued by that challenge, bringing forth the color and beauty and magic that exists in the winter.”

Inspiration for the piece came from Walters own deep history living in the area, her love of the outdoors and her adventurous spirit. The composition captures the natural beauty of the region reflected in the golden tones of sunset, as well as a nod to the area’s timber history. She included elements in the collage such as music sheets and upcycled Old Mill District guide pages to create depth and texture. The finished piece features the snow-capped mountains, a majestic elk and the iconic Old Mill District smokestacks.

A graphic designer for more than 25 years, Walters began pursuing art full time last year. In addition to curating the Old Mill District’s annual winter theme, Walters has had solo shows at Tumalo Art Company and Spokane’s Marmot Art Space in 2019 and was part of a group show highlighting artists from the western part of the United States at the Favell Museum in Klamath Falls. She also created the foundational art piece for the Deschutes Children’s Foundation’s signature fundraising event, Ripples. Walters is currently working on signature artwork for the Deschutes River Conservancy’s annual RiverFeast dinner and auction in April.

The original artwork will be on display at Tumalo Art Co. from November 20 through the end of the season. A limited amount of the exclusive holiday ornaments will be available for purchase at the art gallery and SantaLand after Thanksgiving.

What can we learn from the McDonalds and Google workplace relationship scandals?

CHICAGO, IL, US, November 16, 2019 /EINPresswire.com/ — The forced departure of McDonald’s CEO Stephen Easterbrook because of a romantic relationship with a subordinate grabbed the headlines recently. Hot on its heels came reports of an investigation into sexual misconduct by Google executives including parent company Alphabet’s Chief Legal Officer David Drummond.

What is going on? In this day and age, after the rise of the #MeToo movement and all the talk about ethical behavior in the workplace why are such high-profile cases happening? At a time when employees are seeking to work for companies with the right kind of culture why is this conduct seemingly on the rise? More importantly, what can be done about it?

It used to be the case that CEOs were fired because their failure was financial, not moral. But that’s all changed. The number one reason for executive dismissals is bad behavior rather than inferior financial performance, according to a 2018 study of the world’s 2,500 largest public companies conducted by PwC.

It was the first time since PwC, one of the country’s largest auditing firms, began tracking executive turnover nineteen years ago in its “CEO Success” study. In fact, 39 percent of the eight-nine CEOs were let go because of sexual misconduct allegations or other ethical lapses such as fraud, bribery, and insider trading.

Why the rise in these kinds of dismissals? The PwC report suggests three key reasons:

1. More aggressive intervention by regulatory and law enforcement authorities,
2. new pressures for accountability about sexual harassment and sexual assault thanks to #MeToo, and
3. the increasing zero tolerance stance adopted by boards of directors.

Easterbrook is not McDonalds only problem. Following more than fifty complaints of sexual harassment in three years —everything from lewd comments and groping to retaliation—the company last month introduced an anti-harassment training program.

So, that’s a start.

What else can you do? You can, for one thing, prohibit relationships between higher-ups and those who report to them.

A 2018 survey of 150 human resources executives conducted by executive coaching firm Challenger, Gray & Christmas found that 78 percent of companies had introduced policies discouraging dating between managers and their chain of command. That’s a somewhat realistic approach as relationships with subordinates can give rise to allegations of favoritism or, on the other hand, lawsuits if the relationship goes awry. The power imbalance can also lead to claims that the relationship is never truly consensual. It’s a delicate situation because romantic relationships often start at work. A SHRM study, for instance, found that one-third of Americans have dated someone at work. But 28 percent of them chose not to disclose it!

This entire issue is best handled when corporate leadership determines that an inclusive and respectful culture is something it needs to initiate, and then does so in a true partnership with its employees. It’s something I discuss at length in my book Culture Spark: 5 Steps to Ignite and Sustain Organizational Growth.

And it’s something that my team and I at Ideal Outcomes communicate when we help companies across the country embrace culture change.

The point we make is that employees crave the real deal. In an increasingly skeptical business world with shady dealings and date breaches increasingly commonplace, authenticity and honesty are traits in high demand. And the role of the CEO is even more meaningful than you might think. A Fleishman Hillard study found that 84 percent of Americans equate a CEO’s integrity with that the companies they lead. A CEO scandal reflects badly on the business as a whole.

Footnote: Don’t feel too bad for McDonalds’ Easterbrook getting the boot. His exit package came to $41.8 million which included six months’ severance pay, shares cashable in the future, and other equity. And that’s on top of $23.8 million in stock options that he could immediately exercise. In 2018 Easterbrook made $15.9 million—2,124 times more than the median income of the burger chain’s employees. But that’s a topic for another day.

California Jury Rejects Abuse Claim Against USA Swimming

STOCKTON, CALIFORNIA, USA, November 16, 2019 /EINPresswire.com/ — A California jury today ruled in favor of USA Swimming in a lawsuit brought by a swimmer who had alleged sexual abuse by a coach of a local Stockton swim club.

The jury of 8 women and 4 men deliberated less than 3 hours before issuing a verdict finding that USA Swimming did not fall below the standard of care, and was not responsible for the conduct of a coach employed by the former Stockton Swim Club.

USA Swimming’s attorney, William Kronenberg, of the Oakland based civil litigation law firm, Kronenberg Law, PC, said the jury’s decision was an important vindication of the organization’s athlete protection program.

“USA Swimming has worked very hard to develop and institute a comprehensive program to protect its swimmers,” said Kronenberg, and this case is the first time a jury was asked to determine whether it met the standard of care for a youth serving organization. The speedy affirmation by the Stockton jury should be welcome news to the thousands of swimmers at the more than 3,200 member clubs throughout the U.S.

According to Kronenberg, “The jury was presented with the entire athlete protection program, from the Code of Conduct, mandatory screening and training of coaches, to educational models for parents and swimmers along with expert testimony which found it met or exceeded the standards necessary for a safe environment.” While no youth serving organization can ever be 100% safe, the jury conclusively found that USA’s program was properly designed, implemented and staffed.

The trial has made headlines following the release of multiple news stories by the swimmer’s attorney, including releasing the deposition transcript of USA Swimming CEO Tim Hinchey, who was hired in July 2017. The swimmer’s attorney has publicly commented on the CEO’s lack of background or training in the prevention of sexual abuse, both prior to and even after the jury rejected those claims.

Kronenberg said that the jury saw right through the argument that a CEO of a national organization should have specialized knowledge about abuse prevention.

“Preventing sexual abuse is a specialized field that requires both extensive education, training and experience, much like that received by members of Child Protective Services, and USA Swimming has a department staffed with equally well trained personnel. Mr. Hinchey does not have that background or training, he is the CEO, not the head of that department,” Kronenberg said.

According to Kronenberg, “The criticism of Mr. Hinchey by opposing counsel is unfair and misguided, but some attorneys prefer trying a case in the media, instead of listening to the message sent by the jury with its verdict.”

Coral Reef Protection

She lives in Concord, New Hampshire, and plans to visit towns around the state, asking citizens for their suggestions as to what our Republic needs now. Mary Maxwell describes herself as a states' right maniac, urging devolution to the states, and removal of all unconstitutional involvement by the Congress in matters not assigned to the feds per Article I, sec 8. Mary grew up in Boston but moved to Australia in 1980 for marriage. Her husband, George Maxwell, MD, died in 2000. In 2017 she came to the US again and campaigned for the US Senate seat vacated by Jeff Sessions in Alabama. She lost the nomination to Judge Roy Moore.

In 2017 Mary filed a lawsuit against President Trump — a war-powers case — for his unconstitutional threat to nuke North Korea. She is a graduate of University of Adelaide Law School, with a BA from Emmanuel College Boston, and a PhD in Politics from Adelaide.
